THE CLUTCH AND GEARBOX CENTRE

1 Estimates

An estimate is considered an approximation of the likely costs involved.  All estimates are valid from 14 days from the dispatch of the estimate by the Company to the Customer.  If the Customer deposits a vehicle with the Company for the purpose of an estimate, a storage charge based on the Company’s current rates will be made to the Customer applicable from the 15th day after the dispatch of the estimate by the Company unless the estimate is accepted by the Customer within 14 days of such dispatch or the vehicle is removed by the Customer from the premises within that period.

1.2 Prices are based on prices current at the time of preparation of the estimate, the Company reserves the right to increase such prices if the price to the Company is increased between preparing the estimate and obtaining the goods.

1.3 Unless otherwise agreed in writing, if it appears during progress of any work that the estimate will be exceeded by a significant amount, the Company will not continue the work without further express permission (which need not be in writing) from the Customer.

2 Uncompleted works

2.1 If for any reason work requested by the Customer is not carried out in full, the Company will charge a reasonable amount for any work actually done and the then current price of any goods supplied or fitted or both.

3 Variations

3.1 Any variation agreed between the Company and the Customer in work to be done or goods to be supplied shall be deemed to be an amendment to this contract and shall not constitute a new contract.

3.2 No order which has been accepted by the Company may be cancelled by the customer, except with the agreement of the Company and on Terms that the Customer indemnifies the Company in full against all loss (including loss of profits) costs, damages, charges and expenses incurred by the Company as a result of cancellation.

4 Time

4.1 The Company will use its best efforts to do work supply or supply goods within any time period notified to the Customer but time shall not be of the essence and Company will not be liable for delays.

5 Completion of work and payment

5.1 All goods shall be paid for upon delivery unless credit has been agreed in advance.

5.2 Work shall be deemed complete when the Customer is advised by the Company that such work is complete.  The Customer will pay the Company for all work done and goods supplied as well as any storage charges before any vehicle may be removed from the Company.

5.3 If a vehicle is not collected by the Customer within 7 days of the Customer being advised that work is complete the Company will charge for storage of the vehicle at its current rates.  The Company may sell the vehicle if the Customer shall fail to pay monies due to the Company and collect the vehicle within 3 months of being notified that the work has been completed and of the Company’s intention to proceed to sell it.  Upon any such sale the Company shall pay the balance of the proceeds of the sale to the Customer after deduction all money due to the Company and all costs of sale.

5.4 Interest at the rate of 2% per month (apportionable by the day) will accrue on all overdue payments.

6. Warranty

The Clutch and Gearbox Centre Ltd applies a 12 month/12000 mileage warranty for reconditioned gearboxes only subject to the following conditions: Repaired only transmissions will only apply a limited warranty on labour and fitted parts that were replaced or fixed in the original job are covered.

6.1 If a defect/problem does arise it must reported to us immediately when first encountering or the warranty will be void.

6.2 The defect is not caused by any modification, alteration, repair or attempted repair, excluding works carried out by the Clutch and Gearbox Centre Ltd.

6.3 The warranty does not cover any costs that may arise as a result of towing or recovery; Automatic vehicles that have been towed will make any warranty from The Clutch and Gearbox Centre Ltd void, nor does it cover any consequential costs that maybe incurred by the customer, or any other vehicle damage as a result of misuse, neglect or alteration.

6.4 If a gearbox has been supplied but not fitted by The Clutch and Gearbox Centre Ltd, the customer is responsible for removing the unit and returning it to The Clutch and Gearbox Centre Ltd, if the customer wishes the Clutch and Gearbox Centre Ltd to remove and refit the gearbox a fitting charge will be made.

6.5 If a gearbox has been supplied but not fitted by The Clutch and Gearbox Centre Ltd, The Clutch and Gearbox Centre Ltd will not be held liable for any substandard fitting. Any unit that has been tampered or altered in order to fit the gearbox will void the warranty with immediate effect.  This includes the incorrect grade and amount of oil; only genuine oil is to be used.

6.6 Automatic cars must NOT be towed under any circumstances.

6.7 The reconditioned warranty is valid for 12 months/12000 miles.  The mileage MUST BE given to The Clutch and Gearbox Centre Ltd if fitted by a 3rd party at the time of vehicle completion of the gearbox if no mileage given warranty is void.

6.8 During the term of the 12 month/12000 mileage gearbox warranty, The Clutch and Gearbox Centre Ltd will make good any defect, free of charge from materials and labour providing that the vehicle gearbox was fitted by The Clutch and Gearbox Centre Ltd, so long as:

·          If the defect is caused as a result of misuse, neglect, accident, racing or speed trials or any other cause that is found.

 

·          ONLY genuine oil is to be used.

 

·          The defect is reported to The Clutch and Gearbox Centre Ltd immediately.

 

·          The gearbox/vehicle is returned to The Clutch and Gearbox Centre Ltd for examination, and any necessary repair and replacement as soon as practicable within the terms of the warranty, and returned to us at the customers cost. In circumstances where warranty work is required the vehicle/gearbox will take precedence.

 

·          Customers that request gearboxes and second-hand parts that have been supplied by themselves new or second hand there will be no warranty given or implied on that gearbox.  Gearboxes that are found to be faulty will incur additional labour costs for secondary removal and refitting.  This will involve more labour time and inconvenience to the everyday running of our fitting station.  

 

·          ALL OUR RECONDITIONED OR REPAIRED GEARBOXES DO NOT COME WITH A NEW CONCENTRIC SLAVE CYLINDER UNLESS REQUESTED.
